History of Legalization in Idaho
Idaho has one of the most stringent cannabis systems of law in the United States as of July 2025. There has been no legal means for either medical or recreational marijuana up to this point. Idaho has prohibited cannabis since the early 1900s based on the anti-marijuana laws United State of America largely embraced. In 2015, Governor Butch Otter vetoed SB 1146a that passed the legislature which made available a small amount of CBD oil with 0% THC to children with severe epilepsy on the basis that it did not comply with federal law. With the 2018 Farm Bill in place, CBD products with no THC are available to Idahoans as well as residents from other states. The 2018 Farm Bill legalized hemp derives CBD on a federal level as long as it contained less than 0.3% THC. The current Idaho state law prohibiting every possible legal path to to all marijuana usage is incredibly strict as cannabis is classified as a Schedule I controlled substance without an exception for the medical usage of marijuana. The Idaho legislature has made several attempts, which have not resulted in any law changes relative to medical marijuana. The Idaho Cannabis Coalition also offered a filing option for approximately 57,000 signatures to be gathered for a medical marijuana initiative in 2020, but that law was rendered moot by legal issues.
House Bill 126, a medical marijuana bill, failed in the Idaho legislature in 2021. It would have legalized medical marijuana for certain conditions, such as cancer and PTSD. Senate Bill 1017 was defeated in 2023, to limit access to medical cannabis due to security and public safety concerns.
Possession of small amounts of cannabis is a misdemeanor (under 3 ounces) - with a penalty of up to a year in prison. Marijuana possession in Idaho can be punished with up to 7 years in prison and a $1,000 fine for possession of more than 3 ounces. A recent poll in April 2024 by Idaho Statesman indicated that 68% of people were in favor of legalizing medical marijuana, even while state lawmakers were not in support.
